The points of potential collision between responsible workplace management and privacy law are growing. Human resources managers and in-house counsel deal with personal information constantly. Private and public sector regulation of handling personal information has grown through legislation, court and tribunal decisions and regulator activity. Exemptions for "employee records" in private sector regulation only ever gave limited protection, and have been chipped away further in recent decisions. A diverse and indirect workforce means that rules apply differently across a single workplace. At the same time, the ease with which personal information can be gathered and the compliance expectation that it will be has increased.
